Many attorneys say that spousal support, like child support, is determined by computer programs. This is simply not true. Only in new cases where "temporary" support is requested will the Court use the computer to calculate spousal support. Permanent support is determined using a complicated balancing test. It will generally be lower than temporary support (if it is awarded at all) and, in most cases will carry a termination date, even in a lengthy marriage. If you are considering a divorce and would like to see how much you might either get, or have to pay in temporary support, call me and find out how to receive a printout of guideline support. I cannot emphasize enough the importance of obtaining experienced counsel either to initiate or defend a spousal support modification proceeding. We offer many levels of assistance in this area from simple consultations to full representation. However, this is one area where you should avoid representing yourself. |
